Terms of Service & Platform Agreement

1. Agreement To Terms

By creating an account, browsing content, purchasing subscriptions, unlocking media, posting content, sending messages, booking services, making payments, or otherwise using FansStack, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must not use the platform.

We may update these Terms from time to time. When we do, we will revise the effective date above or otherwise notify users where required. Your continued use of the platform after an update becomes effective means you accept the updated version.

2. Account Registration & Security

You may need to create an account to use certain features. You agree to provide accurate, current, and complete information when registering and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

FansStack or a third-party payment, banking, identity, compliance, or financial service provider may require identity verification, business verification, tax information, payment verification, or other compliance checks before allowing access to certain features or processing certain transactions. You agree to cooperate with reasonable verification requests and to not use false, misleading, stolen, or unauthorized information.

3. Eligibility & Compliance

FansStack may restrict access to users in certain jurisdictions, may require additional compliance steps for creators, and may deny or suspend access where necessary to comply with law, payment processor requirements, financial regulations, platform safety standards, or internal risk controls.

You agree not to use the platform if doing so would violate any law, regulation, sanction, or contractual obligation that applies to you.

Payment providers and financial service providers may apply their own eligibility, identity verification, know-your-customer, anti-money-laundering, sanctions, fraud prevention, and account requirements. Completion of a FansStack account registration does not guarantee approval by any payment or financial service provider.

4. Creator Responsibilities

If you are a creator, you are responsible for the content you upload, the accuracy of your profile information, your compliance with all applicable laws, and your compliance with all platform rules governing content, monetization, disclosures, and conduct.

Scheduled Content Publishing: FansStack allows creators to schedule posts for future publication. Scheduled posts are generally published at or shortly after the selected date and time. Creators should allow approximately 15 minutes for publication. Exact publication times are not guaranteed, and additional delays may occasionally occur due to maintenance, service interruptions, or other operational circumstances.

You represent that you have all rights and permissions necessary to upload and monetize your content, including any required releases, licenses, identity documentation, and consent from any person who appears in the material where required by law or applicable policy.

Creators are responsible for complying with the requirements of any payment provider or financial service used to receive earnings through FansStack.

5. Fan Responsibilities

If you are a fan or purchaser, you agree to pay all applicable fees, use purchased content only as permitted, and comply with any restrictions on copying, redistribution, or commercial use. You may not use the platform to harass, threaten, impersonate, defraud, or exploit other users.

You are responsible for ensuring that your use of the platform and payment methods is lawful in your jurisdiction.

6. Payments, Billing & Platform Fees

FansStack may support multiple payment methods and payment providers, including Stripe, Square, cryptocurrency payment services, and other providers that may be added or removed from the platform from time to time.

Payments may be processed directly by a third-party payment provider. By making a purchase, you authorize the applicable payment provider to process the transaction and charge your selected payment method for the amount shown.

FansStack may charge a platform fee equal to 20% of qualifying creator earnings generated through the platform. Unless a different fee or split is expressly disclosed for a specific product or transaction, the creator's share of qualifying earnings is 80% and FansStack's platform share is 20%, before any applicable payment processing fees, taxes, refunds, reversals, disputes, or other amounts that may be required to be deducted.

The applicable transaction screen, creator dashboard, payout information, or other product-specific disclosure may provide additional information about fees, processing costs, taxes, or the amount ultimately available for payout.

• Recurring billing may continue until cancelled in accordance with the applicable subscription terms.
• Payment processing may be subject to fees charged by the applicable payment provider.
• Taxes or other legally required amounts may be collected or withheld where applicable.
• Refunds, reversals, disputes, and chargebacks may affect amounts credited to a creator.
• Unauthorized or abusive chargebacks may result in account restrictions or termination.
• We may retain relevant billing records to administer transactions, disputes, fraud prevention, and compliance obligations.

7. Cryptocurrency Payments

FansStack may allow certain purchases or transactions to be completed using cryptocurrency or through third-party cryptocurrency payment services.

Cryptocurrency transactions may be irreversible once submitted to a blockchain network. Unless otherwise required by applicable law or expressly stated for a particular transaction, cryptocurrency payments are non-refundable.

FansStack is not responsible for losses caused by incorrect wallet addresses, incorrect blockchain networks, insufficient transaction fees, blockchain delays, network congestion, exchange-rate fluctuations, or other errors or circumstances outside FansStack's reasonable control.

Cryptocurrency transactions may be subject to additional requirements imposed by the applicable payment provider, blockchain network, financial service provider, or applicable law.

8. Creator Earnings & Payouts

Creator earnings are calculated according to the applicable transaction amount, platform fee, payment processing costs, refunds, reversals, disputes, taxes, and other applicable adjustments.

Unless otherwise disclosed for a particular transaction, FansStack's platform share is 20% of qualifying creator earnings and the creator's share is 80% before applicable deductions described in these Terms.

Payouts may be processed through Stripe, Square, cryptocurrency payment services, or other payout providers supported by FansStack. A creator may be required to complete provider-specific onboarding, identity verification, business verification, tax documentation, or other compliance requirements before receiving payouts.

FansStack may delay, restrict, or withhold payouts where reasonably necessary to investigate fraud, disputes, payment reversals, compliance concerns, suspected violations of these Terms, or requirements imposed by a payment provider or applicable law.

9. Digital Content Access

When you purchase or unlock content, you receive a limited right to access that content as described in the relevant product terms, creator terms, or content agreement. Unless otherwise stated, purchases do not transfer ownership of the content or any associated intellectual property rights.

Access to content may be temporary, account-based, or subject to the creator's terms, subscription status, or platform availability. We may remove or restrict access to content where required by law, policy, safety concerns, payment reversals, or rights enforcement.

10. Prohibited Conduct

You may not use FansStack to do any of the following:

• Upload, share, request, or distribute illegal content.
• Post non-consensual, exploitative, harassing, abusive, or fraudulent material.
• Use stolen identity information, fake payment methods, or deceptive accounts.
• Circumvent access controls, security controls, rate limits, or content restrictions.
• Copy, record, leak, scrape, resell, or redistribute content in violation of creator or platform terms.
• Use the platform for spam, phishing, malware, scams, or other harmful activity.
• Interfere with the platform's operation, moderation systems, or security measures.
• Attempt to manipulate payment processing, payouts, platform fees, earnings calculations, or transaction records.
• Use cryptocurrency or other payment methods for unlawful activity, sanctions evasion, fraud, money laundering, or other prohibited activity.

11. Content Ownership & License

Creators retain ownership of their original content unless a separate written agreement states otherwise. By uploading content, creators grant FansStack a license to host, display, distribute, transmit, store, process, and moderate that content as needed to operate the service and enforce platform policies.

Users may not reproduce, distribute, modify, publicly display, or create derivative works from content except as expressly allowed by the creator or by the platform's features and policies.

12. Moderation & Enforcement

FansStack may review, restrict, remove, label, demote, or block content and accounts at our discretion where necessary to enforce these Terms, protect users, comply with law, preserve platform integrity, or address abuse. We may act before or after content is published.

We may suspend or terminate accounts, limit features, withhold payouts where permitted, or require corrective action if we believe a violation has occurred or a user presents a risk to the platform or others.

13. Reporting & Appeals

Users may report content, accounts, or behavior that may violate these Terms or our policies. We may investigate reports and take action based on the seriousness of the issue, available evidence, and applicable law.

Where a review or appeal process is available, we may allow users to request reconsideration of certain enforcement decisions. Some actions may be final if they involve serious safety issues, repeated violations, fraud, payment risk, or legal requirements.

14. Privacy & Communications

Your use of the platform is also governed by our Privacy Policy and Cookie & Tracking Technologies Policy. By using FansStack, you acknowledge that we may send you service notices, security notices, transactional messages, and policy updates.

You may also receive communications related to account activity, purchases, creator interactions, moderation issues, payment activity, payout activity, or support requests. You agree that these messages may be sent electronically.

15. Third-Party Services

FansStack may rely on third-party service providers for payment processing, payouts, banking services, hosting, analytics, support, identity verification, fraud prevention, compliance checks, cryptocurrency transactions, and other operational functions.

These third-party services may have their own terms, privacy policies, verification procedures, eligibility requirements, fees, transaction rules, and account restrictions.

FansStack does not control the independent policies or decisions of third-party payment, financial, identity verification, banking, or cryptocurrency service providers. A provider may decline, suspend, restrict, reverse, or otherwise limit a transaction or account in accordance with its own requirements or applicable law.

We are not responsible for third-party websites or services that are linked from the platform, and you use those services subject to their applicable terms.

16. FansStack Intellectual Property

FansStack, including our name, branding, logos, interfaces, software, design elements, and platform content, may be protected by intellectual property laws. Except for the limited rights expressly granted to you, no rights are transferred by your use of the platform.

You may not use our trademarks, branding, or copyrighted materials without permission, except where allowed by law or by written authorization from FansStack.

17. Disclaimers

The platform is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted access, error-free performance, or that all content, payment methods, or third-party services will always remain available.

Platform availability may be affected by scheduled maintenance, emergency maintenance, third-party infrastructure failures, internet or network disruptions, security incidents, technical issues, or events outside FansStack's reasonable control.

We do not guarantee the accuracy, quality, legality, or reliability of user-generated content, creator content, or third-party services, and you use those materials at your own discretion.

FansStack does not guarantee that any particular payment provider, payout method, cryptocurrency network, or financial service will be available to every user or creator.

18. Limitation Of Liability

To the fullest extent permitted by law, FansStack will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, except where liability cannot lawfully be excluded.

FansStack is not responsible for losses resulting from third-party payment processors, banks, financial institutions, cryptocurrency networks, wallet providers, exchange-rate movements, transaction delays, payment reversals, or provider account restrictions, except to the extent caused by FansStack's own unlawful conduct or liability that cannot legally be excluded.

To the fullest extent permitted by applicable law, FansStack is not responsible for losses, damages, interruptions, delays, or inability to access the platform resulting from failures, outages, disruptions, maintenance, network conditions, or other acts or omissions of third-party hosting providers, cloud infrastructure providers, content delivery networks, telecommunications providers, internet service providers, or other third-party technology services outside FansStack's reasonable control, except to the extent liability cannot lawfully be excluded.

19. Indemnification

You agree to indemnify and hold harmless FansStack, its affiliates, officers, directors, employees, and service providers from claims, damages, liabilities, losses, and expenses arising from your use of the platform, your content, your violation of these Terms, your payment activity, or your violation of any law or third-party rights.

20. Termination

We may suspend or terminate your account or access to the platform at any time, with or without notice, if we believe you have violated these Terms, created risk, or caused harm to the platform, other users, or third parties.

You may stop using the platform at any time. Certain provisions of these Terms will continue after termination, including provisions relating to intellectual property, payment obligations, creator earnings, indemnification, dispute resolution, and limitations of liability.

21. Governing Law & Disputes

To the extent permitted by law, these Terms and any dispute arising from your use of FansStack will be governed and interpreted according to the laws applicable to the company's operating jurisdiction, without regard to conflict of law rules, unless a different rule is required by local law.

Additional dispute procedures, arbitration requirements, or venue rules may apply if stated separately in a related policy, purchase term, or legal notice.

22. Changes To These Terms

We may update these Terms at any time to reflect product changes, legal developments, security practices, payment provider changes, or business needs. If changes are material, we may provide additional notice where required.

Continued use of FansStack after updated Terms take effect means you accept the changes.
